UNISCO noticed to an issue of extremely dangerous represented in illegal transference of world heritage from a country to another especially that happened during occupation and colonialism period taking into account that most countries subjected to occupation are wealthy in their heritage and culture However, exposure of cultural properties of any is considered as violation that law criminalized, including vandalism, smuggling, or theft of any national monuments.

It is necessary to define the applicable law that should be effect on who commits that crime result in damages to these properties, where arises the question: how we can judge the actor with tort liability according to criminal law, law of antiquities, environmental protection Act, or tourism law? This matter needs law enforcement which criminalizes harmful acts that come over properties and cultural heritage.

Through our study we shall apply method of rules of attribution in international contracts which provided in Hebrew manuscripts what calls (Iraqi Jewish Archive) which seized by American occupation troops of Iraq.

Rules of attribution considered to be the basic technical means restored by legislator to solve conflict problem resulted of touching the international private relationship by a foreign factor.
