Abstract EN

In trying to highlight the impact of the constitutional amendment of 2016 on the powers of the President of the Republic and the Prime Minister in the exercise of the power of regulation, it turns out that the statute of the President of the Republic keeps always his supremacy as far as these powers are concerned.

Indeed, the President retains the power to practice independent regulation in a broad field; a power which is not subject to any restriction, except that it is limited by the non-violation of the powers of ordinary and organic legislation protected and reserved to Parliament.

On the other hand, the Constitutional Founder, through the amendment of the Constitution in 2016, released the Prime Minister from the restriction of the approval that was previously to be granted by the President of the Republic to executive decrees.

However, this did not change the status of the Prime Minister.

This is only a procedure to facilitate the administrative work of the Prime Minister.
