Abstract EN

The Shura Councel Law in Iraqi Kurdistan Region No 14 of 2008 adopted the double judicial system in Kurdistan.

In accordance to this law, the councel practices two different powers which are Advisory power in intaiting advisory ( counsultative) opinions, and drafing law proposals, and ajudicion power aims to hear administrative disputes and guarantee unified implementation of laws.

This law includes anumber of advantages in regulating these issues, however, it contains legal gaps in the law itself and the draft legislation This law permeates many legal shortcomings, in addition, it contains substantial mistakes in a tangible manner, which requires the legislator in the Kurdistan region to resort to amend this law in the way that compatible with the role and fuction of the Consultaive Councel of the region and keep abreast of future developments.
