قد يواجه القاضي بعض الصعوبات أثناء مزاولته للفصل في موضوع النزاع المعروض علية لذا يستعين القاضي بالخبير لمساعدته في استجلاء بعض النقاط الفنية والتقنية للنظر في الدعوى ويكون الوقوف على هذه المسائل مطلب أساسي للفصل في الدعوى وإذا حكم القاضي فيما لا يعلمه دون الرجوع لأصحاب الخبرة في الأمر المتنازع فيه فان حكمة بذلك يكون جائرا ومعيبا بالقصور وقابلا للنقض لذلك يقترب عمل الخبير من عمل القاضي حيث أن كلا منهما يطلب منة تقرير المسائل محل البحث والإدلاء براية وهو بهذا الوصف يكون الخبير في مركز قانوني خاص فهو مساعد وقتي للقاضي في الفصل بالدعاوى التي تحتاج لتدخل الخبير.
