Usually, the employee who exploits his, her influence is sentenced to a criminal judgment, because the exploitation of his, her influence is considered a crime that is harmful to the public interest.

A disciplinary penalty as a consequential punishment imposed on the employee exploiting his, her employment.

.

However, some laws exclude from the scope of the amnesty provisions applicable to subordinate punishment, as well as crimes against honor and impartiality, the employee exploiting his employment influence can not return to his job, because the amnesty is limited to the original punishment without subsidiary punishment unless the amnesty law stipulates otherwise.

Other laws provide for amnesty provisions to apply to the original and consequential and complementary penalties, so that the employee exploiting his or her functional influence covered by the Amnesty Law can return to his or her position
