The process of merging between companies that do not belong to a single nationality and determining the nationality of a particular company and whether it is national or foreign, has many important implications, including with regard to the internal field, especially where it proves the enjoyment of all the rights enjoyed by nationals in most cases, and what It derives from the obligations normally assumed by nationals in exchange for the enjoyment of the nationality of the State it grants them.

The effects on the international sphere are also a matter of protection.

The enjoyment by a company of the nationality of a particular State would determine the right of that State to address its protection diplomatically if it were to be exposed.

In this research, we will focus on the most important criteria in establishing the nationality of companies resulting from the transboundary merger.
