The legal regulation of the procedures for waiving the trial in the civil case is one of the important procedural means that the legislator has omitted from enacting integrated legal texts that simplifies those civil procedures that the litigants can use when the trial is abandoned in the civil case.

The lawsuit shall have the right to waive and sue this lawsuit before a competent court again.

The Iraqi legislator did not know the assignment and did not distinguish it from any other legal systems that might mix it, nor did he determine those legal procedures that the litigants answer their behavior upon the assignment.
