The right custody is among the human right that have received the attention of various comparative legislation, including the Algerian family law, and given the nature of this right, his protection was not limited to the provisions of the family law, rather contributed to the jurisprudence of the supreme court, which despite its great role in protecting this right, except that its shortcomings, it prevents its role in protecting the right to custody, which must remain based on his protection of the family law.
