The physician knows that he is not infallible during the execution of his duty.

Nevertheless, it is preferable not to prosecute and questioning the cause damage to others, this pursuit will cause him to hesitate to treat the patient; this in effect will adversely and negatively affect the patient.

When the Jordanian legislator enacted the Medical and Health Liability Act of 2018, he outlined the medical mistakes resulting from ignorance, negligence, neglect and unwarranted skill, as none of us is outside the fence of responsibility.

Medical responsibility between the doctor and the patient is based on care not careless or healing.

This research deals with the statement of medical mistakes committed by the doctor and the extent of his liability under the Jordanian Civil Medical and Health Liability Law of 2018.

The Jordanian legislator resolved this legal problem and initiated precedence of developing a law to govern the relationship between the patient and the doctor, in which it improves the relationship between the parties through defining the rights and obligations, this law allows the doctor to work in a rather comfortable conditions without pressure and secures the rights of the patient in case of fault as well as keeping pace with scientific and technological development and new sophisticated issues previously not dealt with in the legislation and legal books of the today, In order to control the very important issue of human life in light of many medical mistakes committed by the doctor, whether in the personal clinic or in public and private hospitals, whether through diagnosis or treatment
