يعد موضوع تعويض الضرر الأدبي الناتج عن هجر الزوجة من الموضوعات المهمة بشكل كبير و التي لم تحض باهتمام فقهي و تشريعي يتناسب مع أهميته و ذلك لصلته بموضوع حساس يتعلق بحقوق الزوجة و مشاعرها و عواطفها و حمايتها من التعنيف الذي يمارس تجاهها مِن قبل الزوج و ذلك بهجرها هجرا غير مشروع أي بدون عذر أو سبب يبيح ذلك الهجر إلا إن و بالرغم من أهميته و كثرة دعاوى الهجر المقامة أمام القضاء العراقي فقد كان متردد في منح الزوجة الحق في طلب التعويض عن الضرر الأدبي الذي لحق بها مِن هجر زوجها لها هجر غير مشروع و لردع الزوج من التمادي في ظلم الزوجة و هدر حقوقها و أهمها حقها في إشباع غرائزها التي أودعها الله في البشر و جعل الزواج الطريق الشرعي و الصحيح لإشباعها و عليه كان حري بنا أن نتناول هذا الموضوع بالبحث و التحليل و إعطائه الاهمية التي يستحقها عله يفتح افاقا اوسع و يكون نقطة انطلاق لتشجيع الباحثين بتسليط الضوء عليه و التعمق فيه بشكل أكبر تلك الأهمية التي بررت الحاجة إلى بيان المقصود بضرر الهجر بشكل مانع جامع كون هذا المفهوم لم يتم تعريفه مسبقا و بيان كل ما يتعلق بذلك المفهوم من خصائص و صور علاوة على ذلك بينا موقف الفقه القانوني فيما يتعلق بموضوع التعويض عن ضرر الهجر الذي أجاز للزوجة الحق بالحصول على التعويض عن الضرر الأدبي الذي سببه لها هجر زوجها لها هجرا غير مشروع .

English Abstract

The issue of compensating non-pecuniary damage resulting from abandonment of the wife is one of the most important subjects which did not advocate jurisprudential and legislative attention commensurate with its importance because of its relation to a sensitive subject regarding the wife's rights, feelings and emotions and protection from the abuse practiced against her by the husband by illegal abandonment without any excuse or The reason for this is the abandonment, but despite the importance and frequent frequency of those cases before the judiciary, but these claims were rejected because there is no article in the law that gives the wife the right to seek compensation for the moral damage caused by her husband's abandonment of her illegal abandonment and to deter the husband from continuing injustice Wife and the waste of their rights The most important of its right to satisfy the instincts that God bestowed in human beings and makes the Marriage the legitimate way to satisfy sexual needs It is therefore important that we address this issue with research and analysis and give it the importance it deserves.

It opens up wider horizons and is a starting point to encourage researchers to shed light on it and deepen it further.
