Abstract EN

Summary: Nationality is the tool of the countriesthrough which the people›s corner ison their territory, it is not imagined theexistence of a state without a people, butthe name of nationality is newly emerging, it appeared with the emergence of themodern state, and this calls for the questionof the existence of the idea of nationality inIslamic law, and the statement of this ideawill come in its place from this research.

In modern reality, the situation has changedradically with the continuing renaissance, as human minds have begun to limitgeographical boundaries between states; each state has become independent ofeach other, with its own systems and laws, including the nationality law of each state.

Because of the need to preserve thenationality of a state, because of the rightsand duties it entails between the individualand the country to which he belongs, theresearcher saw the importance of studyingthis subject by exposing the obligationsof withdrawal of nationality in Islamicjurisprudence and Iraqi positive law in thelight of the purposes of sharia.
