Abstract EN

Before 2005, The Iraqi constitution gives some authorizations for the administration, officers, etc.

However, the 2005 constitution stopped these authorizations.

And gives all the privilege to the court only.

On the other hand, the higher federal court in some justifications assumes this attitude.

The administration pushed by real needs, ask to give back these privilege.

In this research, discuss the problem of the effect of stopped some authorizations and some privilege.

And propose some solutions for this problem.
