Arabic Abstract

هدفت هذه الدراسة إلى بيان مفهوم الملكية العقارية بوجه عام والطبيعة القانونية للملكية الشائعة و طرق كسب الملكية الشائعة في القانون المدني الأردني رقم 43 لسنة 1976 و تعديلاته و قانون أصول المحاكمات المدنية رقم 24 لسنة 1988 و تعديلاته و كذلك تداولت الدراسة تقسيم الأموال الغير منقولة المملوكة على الشيوع عن طريق اللجان في دائرة الأراضي و المساحة وفقًا لقانون الملكية العقارية رقم 13 لسنة 2019.

خلصت هذه الدراسة إلى مجموعة من النتائج أهمها أن المال الشائع يكون مملوكا لأكثر من شخص و تكون إدارة هذا المال من حق الشركاء مجتمعين مما يؤدي إلى دوام النزاع بين الشركاء في أغلب الأحيان الأمر الذي قد يؤثر على الانتفاع بالمال الشائع و التصرف فيه فكان لا بد من الخروج من هذا الوضع بقسمة المال الشائع للمحافظة على أواصر المحبة و التعاون بين الشركاء على الشيوع و لأن بيان الحصة الخاصة لكل شخص مستقل يحفزه على العمل و الاستثمار و حسن التصرف و زيادة الإنتاج الأمر الذي ينعكس على المصلحة العامة للمجتمع نتيجة لذلك تم تشريع قانون الملكية العقارية حيث قدم حلول لمشاكل مزمنة لطالما رافقت مسائل العقار من حيث طول الفترة الزمنية و النفقات التي كان يتطلبها عملية القسمة عن طريق المحاكم حيث ان اللجنة لن تتقيد بإجراءات التقاضي العادي و مواعيدها فقد يتفق الشركاء مع اللجنة على عقد جلسات طويلة و مكثفة للتسريع في حسم مسألة إزالة الشيوع إلا أنه في المقابل يظهر أن قرارات لجنة إزالة الشيوع يطعن فيها أمام محكمة البداية فقط، والتي يكون قرارها قطعيا و هذا حرمان الشركاء من درجة من درجات التقاضي و كذلك يخشى من قلة الخبرة لدى أعضاء اللجنة في مسألة إزالة الشيوع الأمر الذي يتطلب إعطاء دورات مكثفة لأعضاء اللجنة لتحقيق الخبرة لديهم

English Abstract

This study aims to explain real estate ownership law in general, and the legal nature of common law property and the techniques to acquire common property in Jordanian civil law number (43) of 1976 and its amendments, and the origins of civil courts number 24 of year 1988 and its amendments, also this study approaches the apportionment of immovable property owned by the common according to department of lands and survey committees according to the low of real estate ownership number (13) of year 2019.

This study summarize a number of conclusions, most importantly that immovable property owned by the common by more than one person, and managing this is the right off all partners, which leads sometimes to conflict between them, this affects how to benefit from immovable property owned by the common and how to handle it.

So to overcome this obstacle, it has to be divided to maintain good relationships and cooperation between partners.

And since everyone knows what they own they are more motivated to work harder, invest, and have a good conduct and increase production, which affects common interest for society.

Therefore real estate ownership law legislation has provided solutions to long¬standing problems that associated real estate, from long periods of time and the costs it required to allotment though courts, considering that committees do not oblige to normal legal proceedings, partners might agree to hold long meetings with committees, to fasten the decision to removal of communion , on the other hand it appears that committee decision are not impeached in Former Court of First Instance which gives a final decision.

This absolves the partners from any degree of further legislation; it might also suffer from lack of experience within committee members regarding removal of communion, requiring them to take extensive courses to further their knowledge in the matter.
