Arabic Abstract

تناولت هذه الدراسة تدابير قانون الأحوال الشخصية الأردني للمحافظة على استمرارية عقد 1- بيان مفهوم الزواج و حكمه و أهميته، بالإضافة إلى أهمية المحافظة عليه.

2- بيان التدابير التي يأمر قانون الأحوال الشخصية الأردني رقم ( 15 ) لسنة 2019م العاقدين و أطراف العلاقة بعقد الزواج بمراعاتها، و ذلك قبل إجراء عقد الزواج، بغية إقامة هذا العقد على أسس سليمة تمكنه من الاستمرار طوال حياة الزوجين أو أحدهما، و دراستها دراسة فقهية .

الزواج دراسة فقهية مقارنة، وبحثها من خلال ما يلي : 3- بيان التدابير التي يأمر بها القانون المذكور أعلاه العاقدين وأطراف العلاقة و أطراف العلاقة بعقد الزواج بها عند إجراء عقد الزواج، و دراستها دراسة فقهية مقارنة.

4- بيان التدابير التي يأمر بها القانون المذكور أعلاه بعد إجراء عقد الزواج، للمحافظة عليه، و دراستها دراسة فقهية مقارنة.

و قد تفرعت هذه الرسالة إلى أربعة فصول، و هي على النحو التالي : الفصل الأول - الزواج : مفهومه، و حكمه، و أهميته.

الفصل الثاني - التدابير القانونية التي تسبق إجراء عقد الزواج الفصل الثالث - التدابير التي يطلبها القانون عند إجراء عقد الزواج الفصل الرابع - التدابير القانونية للمحافظة على عقد الزواج بعد انعقاده.

و للرسالة خاتمة تضمنت أهم النتائج و التوصيات التي توصلت إليها خلال دراستي.

English Abstract

This study is dealt with the Jordanian Personal Status Law measures to preserve the continuity of the marriage contract - Comparative juristic study, and examined through the following: 1- Explain the concept of marriage, its ruling and its importance, in addition to preserve the continuity of it.

2- Clarify the measures directed by the Jordanian Personal Status Law No.

(15) of 2019 to the contract’s parties and their guardians to be considered in the marriage contract.

This is before making it, in order to establish this contract on sound grounds that enable it to continue throughout the life of the spouses, or one of them by studying it in a comparative juristic way.

3 - Explain the measures directed by the aforementioned law, the contract’s parties and their guardians when conducting the marriage contract by studying it in a comparative juristic way.

4 - Explain the measures directed by the aforementioned law after making the marriage contract, to maintain it by studying it in a comparative juristic way.

The research was divided into four chapters as the follow: Chapter one – Marriage: its concept, rule, and importance.

Chapter two - Legal measures preceding the marriage contract Chapter three - Legal measures during the marriage contract Chapter four - Legal measures to preserve the marriage contract after it has been concluded.

The research has a conclusion that included the most important results and recommendations that I reached during my study
