Criminal policy in the areas of criminalization and punishment plays a key role in ensuring the effectiveness of the criminal rule, the protection of the individual's private interest and the guarantee of public order, security and tranquility, and since traffic offences do not often involve a criminal risk that is prior to their confusion.

As a result, most traffic legislation initially provides for light penalties in comparison to other crimes, sanctions that have not achieved the desired goal of reducing the phenomenon of traffic accidents.

States have taken more varied and comprehensive actions and efforts to ensure the flow of traffic on public roads within and outside cities in order to protect people and property from the dangers of traffic accidents.
