The research sheds light on the issue of postponing the implementation of the penal ruling, stating its nature, and the aim of the research is to clarify the Iraqi law's position on taking all cases of implementation postponement.

The research problem was represented in the following questions: Has the Iraqi legislator agreed in choosing all cases of postponement? And was the period of postponement for some The cases are appropriate? , The research dealt with the concept of delaying the execution of the sentence, as well as the position of the Iraqi legislator towards it, as well as the position of other legislation in question, and a number of results were reached, including that the Iraqi legislator set the period for delaying the execution of the death sentence for a pregnant woman by four months after childbirth, Likewise, the Iraqi legislator did not deal with delaying implementation with regard to the seriously ill patient, As for the most important recommendations that were reached, they included delaying the death penalty for a pregnant woman until after childbirth for a period of two years, and postponing punishment for those suffering from a serious illness that threatens his life.
