Abstract EN

This shar'i and legal dispute aims at circumambulating one of the old fiqh contracts (the Istijar contract based on rooting), which had its role in the legislative sufficiency at the time; However, doctrinal developments in administrative transactions (deal of supplies as a graduation) tend to invoke those Islamic formulas.

In this regard, the study aims to highlight the importance of adapting the supplies deal to the istijar contract, relying on jurisprudential rulings to reach a conclusion (ornament of the supplies deal) that adheres to the legal standards; This will relieve the collective conscience of contracting dealers and take into account their societal privacy, on the one hand, and on the other hand, in order to preserve public money within the framework of the supplies deal.
