Abstract EN

The Waqf (pious leg) differs from other legal behaviors by being a charitable institution, just as much as its religious objectives which are to bring closer to the good God Almighty.

And these characteristics have created many legal problems such as the problem of the legal nature Waqf between considering it as an act or as a behavior by the will alone, and the problems which arise with regard to certain images and descriptions concerning the Waqf as Waqf (pious leg) of the person who lost his reason or a Waqf with negligence, as well as the Waqf of undivided money and money mortgage.Thus the question of form in the Waqf, in addition to the problem of certain legal actions mentioned on the place of Waqf, such as the validity of adherence to the limitation period acquired in the properties of the Waqf.

Le Waqf (leg pieux) se distingue des autres comportements légaux en étant une institution caritative, tout autant que ses objectifs religieux qui sont de rapprocher du bon Dieu Tout - Puissant.

Et ces caractéristiques ont créé de nombreux problèmes juridiques tels que le problème de la nature juridique du Waqf.

Doit-on le considérer comme un simple acte ou comme un comportement volontaire ? D’autres problèmes se posent concernant certaines formes de Waqf, comme le Waqf de la personne qui a perdu la raison, le Waqf avec négligence, le Waqf de l'argent indivis et de l'argent hypothéqué.

Ainsi, outre la question de la forme du Waqf, se pose la problématique de certaines actions judiciaires mentionnées sur le lieu du Waqf, comme la validité de l'adhésion au délai de prescription acquis dans les propriétés du Waqf.
