الاختصاص القضائي في التحكيم قبل صدور الحكم

Abstract EN

The national jurisdiction, through its role of auxiliary to the arbitration system, undertakes a set of actions stand out by supporting the arbitration process before the sentencing, such as intervening in the event of difficulties encountered in the composition of the arbitration court, as well as the complications resulting from the appointment, which is called the reserve competence of the judge in arbitration.

Also, the judge has the right to intervene during the arbitration procedure, by taking, for example, provisional and protective measures, called the judicial intervention provided by the national judge, which is considered as a support to the arbitration court because it shows the extent of the judiciary’s cooperation with the arbitration court.

This cooperation is clearly reflected in the legislative texts regulating such measures in Algerian law, which granted competencies to the national judge, all of this, is an attempt by the legislator to activate the judicial arbitration system and to achieve its effectiveness.

La juridiction nationale, à travers son rôle d'auxiliaire du système d'arbitrage, veille à mener un ensemble d'actions illustrées par le soutien du processus d'arbitrage avant le prononcé de la sentence arbitrale, comme l’intervention en cas de difficultés rencontrées dans la composition du tribunal arbitral, ainsi que les complications consécutives à la nomination, c’est ce que l'on appelle la compétence de réserve du juge en arbitrage.

En outre, le juge a le droit d'intervenir au cours de la procédure d'arbitrage par la prise, par exemple, de mesures provisoires et conservatoires, c’est la compétence d'urgence fournie par le juge national, qui est considérée comme un appui au tribunal d'arbitrage car elle montre l’ampleur de la coopération du pouvoir judiciaire avec le tribunal d'arbitrale.

Cette coopération est clairement reflétée dans les textes législatifs régissant ces mesures dans la loi algérienne, qui attribue des compétences au juge national.

Ce qui constitue une tentative du législateur d’activer le système judiciaire d'arbitrage pour atteindre son efficacité.
