By general rules, the bailee is not liable for loss or deficiency of capital; unless it is extravagance or dissipation, the question that remains to be considered in this sector is whether the non-guarantee of the bailee is a changeable sentence, which intensify liability clause on bailee; Since possession of bailee in is capital is deposited possessory and is very important in community relations, it is irrevocable and necessary that the status of such a condition be explained by legal issues in the content of the research.

This study, reached to this conclusion based on the rational content analysis method with library taking note method, after knowing the nature and extent of bailee responsibility, guaranty condition on bailee, is an example of illegal condition and it is invalid.
