Abstract EN

The issue of court powers in the face of cyber crimes is gaining much attention by many legal researchers, due to the increase in this type of crime, and the presence of legal texts in many legislations; Including Yemeni legislation dominated by it is still traditional.

This research aimed to clarify what is the principle of the judge's freedom to form his conviction from the electronic evidence, the controls that respond to this principle, and the powers that the legislator has granted to the criminal court judge in assessing the electronic evidence.

This research included three sections.

The first topic was devoted to clarifying what the principle of a judge’s freedom is in forming his conviction from the electronic guide, and the second topic was devoted to talking about the principles of the conviction of the criminal judge in accepting the electronic evidence, while the third topic was dedicated to talking about the authority of the criminal judge in estimating the electronic evidence.

In writing this research, it relied on the descriptive analytical approach, as well as the comparative approach, and then concluded the research with a set of results and recommendations.
