Abstract EN

The outbreak of the novel coronavirus raised many legal questions concerning the sufficiency of existing laws to address the implications of the pandemic.

Amongst them is whether the employee is entitled to compensation when infected with the virus.

The incident of infection is distinct compared to common work-related injuries.

This is because of the covert nature of the infection and the time needed for the effects of the infection to appear on the employee, on the one hand, and the difficulty of establishing the link between the occurrence of the accident and the worker’s profession on the other.

The study discusses the most significant problems facing the employee's right to compensation in case of infectious diseases, due to the courts' adherence to traditional notions of work accidents that require the injury to result from a material and external event.

This study is an attempt to draw attention to this problem and calls for the adoption of a broad concept of work accident in the context of an analytical study in the Kuwaiti and Qatari laws.
