Abstract EN

The "Jordanian Defense Law" has an exceptional feature; it differs from other branches of public law because it came into force, but it is not applied.

The application of this law will only be effective in emergencies.

This law has deviated in its provisions from some of the legal principles established in the Jordanian legal system - such as the principle of the separation of powers - which has made it a flexible law.

In addition, the application of this exceptional law reflects a direct effect on other legislations.

The law has also the power to suspend other laws, regulations, or instructions.

Beyond that, the defense law can – legally – suspend in certain conditions higher legislations (the constitution and international conventions).
