Abstract EN

Propaganda, advertisements, misleading and false information are considered a ground for media misinformation during election campaigns.

in fact, it is one of the most serious threats that puts democratic systems at risk, especially in light of the widespread use of social networking sites and instant messaging programs, in addition to considering them as a source of information and news.

this raises several legal issues regarding the criminal control of these threats to the electoral process.

such threats include defamation of politicians, and directing voters in a particular electoral direction because of this misinformation obtained from media during election campaigns, which questions the reliability of the whole voting process and election results.

elections is the mechanism through which political power is transferred, and popular control of the electorate is achieved through electoral funds.

hence, there is no democracy without free, fair, and transparent elections, and no free and fair elections without media.

the latter should allow pluralism and freedom to circulate correct information that is not misleading or false, especially at the time of electoral campaigns during which the attitudes and behaviors of the electorate are shaped.
