Abstract EN

The banking activity is considered as one of the most important economic sensitive and influential activities on the state economic stability.

That's why the Algerian legislator has accorded a paramount importance to organizing and regulating such activity and hence submitted investment in it to particular mechanisms notably on foreign investors agsinst whom restrictive conditions were imposed; amomg them constituting the financial establishment capital .

Therefore, we have focused in this research on the partnership condition through which it is imposed on foreign investors and residents a given rate of shares with the condition of owning a state golden share thanks to which it is imposed a state qualitative control over banks functioning; this is due to considerations of national economy safeguarding from the state point of view.

However; the foreign investor has considered that as a hindrership for his freedom to his constitutionally devoted investment
