يعد الحق في الثقافة من الحقوق المكتسبة التي نص عليها دستور 2016 في المادة 45 منه و هي بذلك تشمل في مجملها التراث المادي و التراث الغير المادي، و قد خصها المشرع بحماية خاصة من خلال إصدار مجموعة من القوانين و منها القانون رقم 98-04 المؤرخ في 15 يونيو سنة 1998 و المتعلق بحماية التراث الثقافي، هذا بالإضافة إلى نصوص قانونية أخرى سنحاول دراستها في هذه المداخلة، من خلال تحديد مفهوم للثقافة و موقف المشرع الجزائري من دسترة هذا الحق.
Abstract EN
The right to culture is one of the acquired rights stipulated in the 2016 constitution in Article 45 of it and thus includes in its entirety tangible and intangible heritage, and the legislator has allocated it with special protection by issuing a set of laws, including Law No.
98-04 of 15 June, 1998 related to the protection of cultural heritage, in addition to other legal texts we will try to study in this intervention, by defining a concept of culture and the position of the Algerian legislator regarding the constitution of this right.
