الإفلات من العقاب يتحقق عندما تتقاعس الدول و المجتمع الدولي بالوفاء بالتزاماتها اتجاه حماية حقوق الإنسان و عدم اتخاذ التدابير المناسبة فيما يتعلق بالحد من تفاقم الانتهاكات الجسيمة لحقوق الإنسان و الخطيرة لقواعد القانون الدولي الإنساني و ضمان ردع و محاكمة الجناة و معاقبتهم، و بذلك يشكل تهديد للسلم و الأمن الدوليين لما الترابط المباشر بين الانتهاكات الجسيمة لحقوق الإنسان و السلم و استقرارا المجتمع الدولي، و لهذا يثور اختصاص مجلس الأمن في تفعيل سلطاته لمكافحة الإفلات من العقاب من خلال تفعيل آليات قانونية و قضائية تتمثل في تشكيل لجان التحقيق و تقصي الحقائق الدولية و إنشاء المحاكم الجنائية الدولية الخاصة و المدولة، و أيضا إحالة حالة تشكل تهديد للسلم و الأمن الدوليين الى المحكمة الجنائية الدولية
Abstract EN
Impunity is achieved when States and the international community fail to fulfill their obligations to protect human rights and to refrain from taking appropriate measures with respect to reducing their hypocrisy Gross and to ensure that perpetrators are deterred and prosecuted and punished, thus posing a threat to international peace and security because of the direct link between gross violations of human rights, peace and stability of the international community.
The Council's competence to combat impunity Through the activation of legal and judicial mechanisms, namely, the formation of commissions of inquiry and private criminal tribunals and the International Criminal Court.
