تمثل ظاهرة الهجرة غير الشرعية هاجسا مخيفا يهدد السيادة في كل دول العالم، المصدرة و المستقبلة ودول العبور، و تصيب العلاقات الدولية بالتصدع، فالهجرة تحدث لعدة أسباب اقتصادية و سياسية وأمنية و اجتماعية و نفسية، و تتأثر ديناميكية الظاهرة بقرب المسافة الجغرافية، مما يجعل بعض دول العبور مستهدفة بحكم موقعا الجغرافي.
ولما كانت دول شمال أفريقيا هي بوابة الخروج من القارة السمراء نحو أوروبا، كان لزاما لأن تنال هذه الدول نصيبها من حركة الأفارقة المهاجرين من دول الساحل نحو أوروبا.
يهدف هذا المقال الى تسليط الضوء على ظاهرة الهجرة الغير الشرعية و مساهمتها المباشرة في تفشي الجرائم المنظمة العبر الوطنية، و المقصود هنا جريمة الاتجار بالبشر التي تعد من الجرائم ذات الصدى العالمي، باعتبار أن تناميها يأخذ بعدا جغرافيا واسع النطاق من جهة، و من جهة أخرى كونها تدخل في إطار الجريمة المهددة للأمن القومي و الجريمة ضد الإنسانية في آن و احد.

The phenomenon of illegal immigration is a source of concern that threatens the sovereignty of all countries : exporters, receivers and transit countries, and weakens international relations.
Migration results from economic, political, security, social and psychological factors.
The dynamics of this phenomenon are influenced by geographical proximity.
As North African countries are the gateway to Europe, they have had to pay their share of African migrants from the Sahel to Europe.
The purpose of this article is to highlight the phenomenon of illegal immigration and its direct contribution to the spread of transnational organised crime.
This is the crime of trafficking in human beings, a crime with universal resonance, because it has a vast geographical dimension, on the one hand, and it is both a crime threatening the national security and a crime against humanity, on the other hand.

Le phénomène de l'immigration clandestine est une source de préoccupation qui menace la souveraineté de tous les pays : exportateurs, destinataires et pays de transit, et affaiblit les relations internationales.
La migration résulte de facteurs économiques, politiques, sécuritaires, sociaux et psychologiques.
La dynamique de ce phénomène est influencée par la proximité géographique.
Les pays d'Afrique du Nord étant la porte d'entrée de l'Europe, ils ont dû payer leur part de migrants africains du Sahel vers l'Europe.
Cet article a pour but de mettre en évidence le phénomène de l'immigration clandestine et sa contribution directe à la propagation de la criminalité transnationale organisée.
Il s'agit du crime de traite des êtres humains, un crime à résonance universelle, parce qu'il a une vaste dimension géographique, d'une part, et c'est à la fois un crime menaçant la sécurité nationale et un crime contre l'humanité, d'autre part.
