يعد موضوع حقوق الإنسان من بين المواضيع التي شغلت و لا زالت تشغل بحوث فقهاء القانون الدولي عامة و القانون الدولي لحقوق الإنسان خاصة، لما لهذه المواضيع من ارتباط وثيق بالإنسان و بيئته التي يعيش فيها، و حرصا على ضمان الحياة الكريمة لهذا الكائن الأسمى على وجه الأرض، و هو الأمر الذي يوجب إزاحة كل لبس يتعلق بالإطار المفاهيمي لهذه الحقوق من خلال التركيز على خصائصها المميزة و التي تنعدم بدونها، مرورا بمختلف التصنيفات لها، و لكن و من دون إغفال المصادر التي تستمد منها هذه الحقوق القواعد المشكلة لها و التي لا محالة هي في توسع و تطور مضطردين، و ذلك كله من اجل تحديد كل ما يتعلق بحقوق الانسان من الجانب القانوني و العملي و لاسيما في مجال الاجتهاد القضائي الدولي الذي سيكون له الأثر البارز مستقبلا في الرفع من مجال الحماية الدولية لهذه الحقوق
Abstract EN
The question of human rights is one of the subjects which has preoccupied and still preoccupies jurists of international law in general and of international human rights law in particular, because of the latter's close relationship with man and his environment, in order to ensure a life of dignity for this human being, which makes it necessary to remove any confusion as to the conceptual framework of these rights, in particular by highlighting their particularities, without neglecting the different classifications of those rights, as well as the sources from which these rights derive their foundations, in order to simplify more profoundly due to the repercussions of this in the field of international jurisprudence, which will have a significant impact in the future by raising the field of international protection of these rights

La question des droits de l'homme est l'un des sujets qui a préoccupé et préoccupe toujours les juristes du droit international en général et du droit international des droits de l'homme en particulier, en raison de la relation étroite de ce dernier avec l'homme et son environnement, afin d'assurer une vie digne à ce être humain, ce qui oblige à lever toute confusion quant au cadre conceptuel de ces droits, en mettant notamment en évidence leurs particularités, sans négliger les différentes classifications de ceux-ci, ainsi que les sources dont ces droits tirent leurs fondements, afin de simplifier plus profond en raison des répercussions de cela dans le domaine de la jurisprudence internationale, qui aura un impact important à l'avenir en élevant le domaine de la protection internationale de ces droits.
