فرضت التحولات الجديدة لتنظيم دولة ما بعد الحداثة إعادة النظر في أساليب تنظيم الوظيف العمومي، لأجل الاستجابة لمؤشرات النجاعة و تحديث العلاقة بين الإدارة و المواطن.
كما استوجبت هذه المفاهيم التركيز أكثر على مفاهيم الفعالية، الكفاءة، الملائمة، النجاعة و العصرنة، للوصول إلى تحقيق حسن الأداء العمومي.
وقد أفرزت كل هذه المقاربات تغيرات جذرية على مستوى مفاهيم القانون الإداري بكل فروعه، ولاسيما على مستوى التنظيم القانوني للوظيفة العامة، من خلال محاولة إدراج مفاهيم و تطبيقات القطاع الخاص على مستوى الإطار القانوني المنظم للوظيف العمومي.

Abstract EN
The new transformation of the post-modern state obliges to renew the methods of the civil service, to apply the indices of efficiency and to improve the relation between the state and the citizen.
These notions required research on efficiency, competence, expediency, modernity, to ensure performance.
These approaches lead to radical changes at the levels of administrative law and mainly on the legal organization of the public service, through the insertion of good private sector practices at the levels of the legal framework of the public service

La nouvelle transformation de l'etat post moderne oblige de renouveler les méthodes de la fonction publique, pour appliquer les indices de l’efficacité et améliorer la relation entre l’état et le Le citoyen.
Ces notions nécessitaient la recherche sur l’efficacité, la compétence, l’opportunité, la modernité, pour assurer la performance .
Ces approches Conduit à des changements radicaux aux niveaux de droit administratif et essentiellement sur l’organisation juridique de la fonction publique, à travers l'insertion des bons pratiques de secteur privé aux niveaux du cadre juridique de la fonction publique.
