إذا جعل القانون لأحد المتعاقدين حقا في إبطال العقد، فليس للمتعاقد الأخر أن يتمسك بهذا الحق.
وفي العقود الملزمة للجانبين إذا لم يوف أحد المتعاقدين بالتزامه، جاز للمتعاقد الأخر بعد إعذاره المدين أن يطالب بتنفيذ العقد أو فسخه مع التعويض في الحالتين إذا اقتضى ذلك
Abstract EN
If the law makes one of the contracting parties a right to annul the contrat, the other contracting party cannot uphold that right.
In the contracts binding on both sides, if one of the contracting parties fails to fullfill his obligations, the other contracting party may, after notifying the debator, demand the implementation of the contract or its compensation in both cases if the case so requires.
Abstract FRE
Si la loi confère à l'une des parties contractantes le droit d'annuler le contrat, l'autre partie contractante ne peut faire valoir ce droit.
Dans les contrats liant les deux parties, si l'une des parties contractantes manque à son obligation, l'autre partie contractante peut, après an avoir informé le débiteur, exiger l'exécution du contrat ou sa résiliation avec indemnité dans les deux cas si le cas l'exige.
