The law is seen as a reflection of society and a fruit of its fruits, because the law is created to regulate the different economic, cultural and social relations that arise within the framework of the society, and because the family is considered as the The basic unit for the construction of society, the Algerian legislator has surrounded it with a legal framework which controls the relations of its members among themselves and guarantees its protection from each behavior violating the values on which the stability of this family is based.

As part of the organization and control of the family relationships that arise between the different members of the family, including husband and wife, parents, sons and daughters, the legislator has worked to establish criminal protection for it against a certain number of behaviors that it considered as crimes, such as penal protection for the marital relationship, penal protection for the Patriarchate relationship, penal protection of children
