Banks are an essential player in economic life, particularly with regard to the policy of protecting institutions or seeking to maintain them in order to achieve economic or social objectives.

On the other hand, the regulation of the civil liability of banks in matters of credit is also an important issue to preserve the institution and protect its creditors.

In this sense, the commercial legislation sought to set up a system of civil liability of the bank in matters of credit without affecting its economic role.
