Upholding the unconstitutionality of laws is a new mechanism under the number 16 – 01 of 2016 year; its purpose is to ensure remote control over the constitutionality of the laws.

The practice often reveals the presence of laws that infringe the constitutional right and freedoms and the failure of the previous political and parliamentary censorship.

In its disclosure; the litigant may in accordance with the new constitutional amendment-challenge the legal provisions that are contrary to the constitution and which will affect his ruling and thus, affect his constitutional right and freedoms, this means that upholding the unconstitutionality of laws has an effect on the protection of public right and freedoms.
