Abstract EN

The previous legal controls over the commencement of the tourist activity in Iraq suffers from a number of problems and obstacles.

And, perhaps, the most noticeable of such is the lack of terms and procedures for granting licenses to practice this activity in adapting to developments and its inability to meet the requirements of this activity and its users.

The wide spread of quite a few activists in the tourism arena even without any legal authorization or the availability of the required legal conditions; these serious implications have reflected in the tourism sector that represents the civilizational façade of the country.

In addition to the presence of quite a few legislative texts that are still in force despite their lack of legal coverage due to its nonconformity with the Constitution of the Republic of Iraq for the year 2005 in force, so we all decided to go through this study under the title (assumptions of licensing to practice tourism activity in Iraq), with the aim of helping the legislative and executive authorities to reorganize the legal structure of the tourism sector as an important and sensitive part of it, which is licensing by practicing tourism activity on new and sound grounds that go beyond the centralism era in which it ascended; and keeping pace with contemporary reality.

In addition to establishing firm legal conditions and procedures so that this profession is only available to those who deserve it.
