It is well known that such contracts whose bulding is not available at the time of the contract it is considered a risk, due to the many dangers that surround it, to avoid these risks and the establishment of a type of contractual credit, the Algerian legislator has tried to provide many guarantees by the terms of the design sale contract, intending to bring about a nodal balance by introducing two types of guarantees, they are legal and contractual guarantees.
