Abstract EN

The Responsibility in general means that the person undertakes the outcomes of his act and he takes into account the punishments that may be imposed on him as a result of violation of the legal rules.

The Responsibility is of two types: an ethical Responsibility in which the person who committed it should receive ethical penalty.

This responsibility is not related to the law.

Also no legal penalty has to be imposed on him.

The second type of responsibility is the lawful one.

It is concerned with the contravention of any legal duty like the civil، criminal and punitive responsibility.

The crime or punitive contravention has pillars that should be available and this is the base or principle.

However، there are concrete reasons for being free of responsibility.

This means that the action is permitted.

Also there are personal causes that are related to the doer which prevent the responsibility and they are called (prevention of responsibility).

There are the other causes which prevent imposing the punishment and they are called (prevention of responsibility) which will be clarified in details later in this research.
