Due to the presence of two authorities in the International Criminal Court that conduct the prosecution and investigation, represented in the Office of the Prosecutor and the Pre-Trial Chamber, which raises problems in the practice of their work between overlap and separation, so the study aims to clarify whether or not there is a devotion to the principle of separation of powers at the stage of prosecution and investigation.
