This research includes the constitutional crisis relating to the presidential vacancy that faced constitutional council in carrying out its duties, which occurred in Algeria during former president's candidature for re-election “Bouteflika”, as the constitutional council was unable to act under external influences, which led to constitutional amendment in order to avert every cause and factor restricting the constitutional council; By clarifying the necessary legal procedure, so that the constitutional court will be able to effectively and efficiently fulfil its role in the case of presidential vacancy.
