Abstract EN

University libraries face many difficulties regarding their goals related to digital transformation, which came in response to the government's orientation aimed at integrating into the digital world.

Perhaps the most prominent difficulties faced by the library are the rights and obligations related to the documents that are still protected and to be digitized, because of the prejudice to the interests of their owners and intellectual property rules.

Accordingly, the study came in order to shed light on how to digitize documentary balances within the framework of legitimate use, while clarifying the images that are considered violations from the point of view of the law.

Contracting for a license to digitize, and contracting alone is not sufficient, but the custodian bodies must issue legal texts that allow the digitization process to be conducted legally in order to preserve the rights of owners of literary works.
