Abstract EN

The Islamic system has sanctified human dignity and prohibited any act that would deprive or diminish this dignity.

Similarly, positive laws have taken important steps to enshrine human dignity and preserve the right to life.

Since armed conflicts tend to lead to a violation of human dignity, there is a growing need for human right policies.

The current article sheds light on the principle of «humane treatment» as termed in the Geneva Conventions and the principle of «mercy» as termed by Islam.

The first section will discuss how the Islamic principle of mercy is applied on the participants of armed conflicts.

The second section will discuss how the Geneva Conventions applied their principle on them.

The third section will compare between the two principles, and show the importance of this study at a structural level.

The conclusion of the research will include the results and proposals.
