The economic transformations that took place in Algeria from an economy oriented to a market economy have a major role in creating sectoral and non-sectoral bodies aimed at controlling the market and ensuring that economic activities do not deviate from the legislative and regulatory provisions, within the framework of the state’s transformation from an interfering state.

In economic activity to a controlling state, and among the important bodies that have a primary role within this goal, is the Competition Council, which is a non-sectoral body and which the legislator granted the legal personality, which entails a number of results, including administrative and financial independence, and thanks to the independence it enjoys , and managed by members who are qualified and experienced in various fields, in addition to the broad powers granted by the legislator to this council, this council was able to carry out its function which is to protect the market from all practices that are considered a restriction on competition in the light of a free market.

But through the laws that organize it, we will try to study these legislation critically to find out the strengths and defects so that we can contribute a little to enriching the legal aspect and stand on all the problems related to this issue from a legal point of view and find solutions to these problems so that the legislator and all the laws can Take advantage of them, and that is the function of scientific research.
