The animal occupies an important economic position due to its importance in preserving biological diversity, and in preserving human life and survival on the surface of the earth, and in view of the dangers that threaten this wealth, whether caused by humans such as overfishing or fires, or by natural factors such as climate change, drought or desertification, It was necessary to develop a legal system that defines its position on the one hand and guarantees it its own legal protection.

The Algerian legislator developed a legal system in line with that, its texts were scattered across many legislations, we find them sometimes within the texts of the Civil Code and the Penal Code and at other times within the environmental legislation, but the student of this The system finds that it did not achieve the desired goal due to many factors mentioned in the conclusion of this research
