يعد التشريع في الأصل العام إختصاص أصيل للبرلمان، فتتولى السلطة التشريعية مهام وضع القوانين وفق القواعد المحددة في الدستور، غير أن مسألة وضع القواعد القانونية لا تقتصر على السلطة التشريعية فقط، و إنما يمتد المجال التشريعي و صنع القوانين إلى السلطة التنفيذية ممثلة في رئيس الجمهورية، فإلى جانب الصلاحيات التنفيذية التي يتمتع بها رئيس الجمهورية، يملك رئيس الجمهورية سلطة ممارسة مهام التشريع عن طريق آلية التشريع بأوامر، هاته الآلية التي فرضتها الضرورة الملحة عززت المركز التشريعي لرئيس الجمهورية و الدخول إلى الميدان التشريعي، ليقاسم بذلك الهيئة التشريعية في إختصاصها الأصيل، و يتمكن من هنا رئيس الجمهورية من مسألة الإنتاج التشريعي و اتخاذ أوامر لها قوة معادلة لقوة القانون، سواء كان ذلك في الظروف العادية أو غير العادية، من هنا جاءت هذه الدراسة تهدف إلى معالجة حالات ممارسة رئيس الجمهورية لسلطته التشريعية، التي قد تأتي بها ظروف عادية، أو تمليها ضرورة إستثنائية، و تحكمها ضوابط قانونية
Abstract EN
Legislation is, in general, an inherent competence of Parliament, so the legislative authority undertakes the task of setting laws in accordance with the rules specified in the Constitution.
The executive powers enjoyed by the President of the Republic, the President of the Republic has the authority to exercise the functions of legislation through the mechanism of legislation by orders.
From the issue of legislative production and taking orders that have a force equivalent to the force of law, whether in normal or extraordinary circumstances, this study aims to address cases of the President of the Republic exercising his legislative authority, which may come from normal circumstances, or due to exceptional circumstances, and is governed by legal controls.
