Abstract EN

The Research aims to identify the most prominent challenges and legal and regulatory obstacles facing Islamic Sukuk in Algeria for the year 2020-2021, based on the analytical method to diagnose the legal loophole for the Sukuk trading in the Algerian financial market.

The study concluded that the Algerian legislator does not recognize the Sukuk as a negotiable security, it was observed through the absence of an explicit legal text for the Sukuk in the Commercial Law and the money and credit Law, As for the characteristics and what the instruments require, the civil law does not support that either, the Civil Law does not agree, This is due to the absence of the dual property upon which the Sukuk is built, also organizationally, the absence of: the special purpose company, legal sharia, Takaful insurance, some Islamic financing contract, Which is one of the main pillars upon which the Sukuk is built, however, the signs of political will remain clear through the statements of the Stock Market and the Bank of Algeria
