This study aims to identify the legal adaptation of the Anglo-American occupation of Iraq after the 2003 war, and its colonization by virtue of decision 1483 taken on May 22, 2003, and whether it could be considered as aggression especially after reaching a concise definition for this crime under article 08 bis of the Rome Statute amended in the Kampala 2010 review conference in Uganda.
It also aims to define the jurisdiction of the court to condemn this crime, or the possibility of considering it as a violation or transgression of the principles and objectives of the UN Charter.

La présente étude vise à cerner l’adaptation légale de l’occupation anglo-américaine de l’Irak après la guerre de 2003, et sa colonisation en vertu de la décision 1483 prise le 22 mai 2003, et s’il pourrait être considéré comme agression surtout après avoir trouvé une définition exacte à ce crime en vertu de l’article 08 bis du statut de Rome, dans la conférence de révision du statut de Rome Kampala 2010 à Ouganda, et de définir la compétence de la cour à condamner ce crime, ou la possibilité de le considérer comme une violation ou transgression des principes et objectifs de la charte des Nations unies.
