This article aims to study one of the most important issues that continue to impede the proper functioning of the International Criminal Court, in this case the influence of political considerations on his mandate, which minimizes the scope of its effectiveness in protection of human fundamental rights, and also in the proper application of international criminal justice.
The impact of political considerations is evident in certain conditions of the Statute of the International Criminal Court, the hostile attitude of the United States towards the Court and the desire to baffle its missions.

Cet article a pour objet l’étude d’une des plus importantes problématiques qui continue d’entraver le bon fonctionnement de la Cour pénale internationale; en l’occurrence l’influence des considérations politiques sur son mandat; ce qui minimise la portée de son efficacité dans la protection des droits fondamentaux de l’homme, et également dans la bonne application de la justice pénale internationale.
L’impact des considérations politiques apparait clairement à travers certaines dispositions du Statut de la Cour pénale internationale, l’attitude hostile des Etats Unis à l’égard de la Cour et la volonté de faire échouer ses missions
