The criminal sanction is an effective legal means to enforce compliance by the administration with the rule of law, and to urge the administration to implement judicial decisions and decisions.
This method has been established by the Algerian legislator according to Law No.
09/01 of the Penal Code, especially Article 138 bis thereof, by criminalizing the employee's deliberate abstention from implementation.
Therefore, the criminal sanction is an effective guarantee to urge public administrations to respect judiciary rulings issued in the name of the people.

La sanction pénale est un moyen juridique pour inciter l’administration à exécuter les jugements et décisions judiciaires.
Ce moyen a été consacré par le législateur algérien selon les dispositions de la loi n° 01/09 qui inclut le Code pénal, notamment l’article 138 bis, et en criminalisant l’inexécution intentionnelle des jugements par le fonctionnaire public.
Ceci étant, la sanction pénale est une garantie efficace pour inciter les administrations publiques à respecter les arrêts prononcés au nom du peuple
