Abstract EN

The issue of legal regulation of the conditions for granting a driving license is one of the central practical issues that deserves in-depth and comprehensive studies, given that the driving license is one of the most administrative means that regulate freedom of movement guaranteed by the constitutions, including the Constitution of the Republic of 2005, according to Clause (First) of Article (44).

By stating that (the Iraqi has freedom of movement, travel, and residence inside and outside Iraq), the requirements of maintaining public order, especially those related to the security of passers-by and their lives from the risk of accidents resulting from driving vehicles are the ones that dictated the legislator to intervene in laying down rules for granting driving licenses.

The issuance of many legislations that regulate the traffic sphere and how to grant a driving license, including the revoked Traffic Law No.

48 of 1971, and the dissolved Destruction Authority Order No.

86 of 2004 amended by Law No.

100 of 2012, and the instructions for vehicle registration and driving license No.

1 And (2) for the year 2009 and its first and second amendments for the year 2018 and finally the issuance of Traffic Law No.
