Abstract EN

The notary, as a public officer, has criminal liability for violations of the rules laid down in the Act, as well as the provisions on documentation, criminal liability, provides for a series of offences which he has committed as a result of the status accorded to him, as well as for serious violations which constitute a felony, a misdemeanour or an offence according to the degree of his fault and the act committed.

The study aims to highlight the most important crimes committed by the notary and the most common offences before him.

One of the recommendations of the study is that false notaries should be exposed by the judicial authorities in which the proceedings were conducted in order to give evidence to others, and that penalties should be increased for notaries because the crimes they commit affect the rights of citizens.
